On January 18, 2011, the collections abuse victim filed suit against NDEX WEST, LLC, for violations of the FDCPA and RFDCPA. The collections abuse victim claimed that NDEX WEST engaged in abusive, deceptive, and unfair practices, violating the FDCPA and RFDCPA by:


(i)                 Placing more than two (2) collection calls per day, more than ten (10) collection calls per week, and more than twenty (20) collection calls per month;

(ii)               Refusing to disclose the caller’s true identity, NDEX WEST’s identity, and that the call was from a debt collector;

(iii)             Threatening or implying that non-payment of the debt would result in “foreclosure, seizure, and auction” of the victim’s property;

(iv)             Contacting the victim via telephone and sending a representative of NDEX WEST to the victim’s residence and placing a letter on the victim’s door, despite being told several times that the house was sold and escrow had been closed;

(v)               Sending the victim’s father-in-law, a third party to this action, collections letters, both certified and regular mail;

(vi)             Contacting the victim’s father-in-law via telephone in an attempt to collect an alleged debt and for purposes other than obtaining location information; and

(vii)           Contacting the victim on a phone number primarily associated with the victim’s work.
